User Terms of Use

In these Terms:

The Platform is operated by The Vilij Limited (“The Vilij”, “we”, “our” or “us”).

The Vilij provides and operates a curated membership community designed to support parents and carers of children with special educational needs and disabilities through information, resources, community engagement and opportunities to connect with independent Experts.

The Platform facilitates connections between Users and independent Experts. Unless expressly stated otherwise in relation to a particular service, The Vilij does not itself provide legal, financial, medical, therapeutic, educational or other professional services.

The Vilij is not a party to any contract for services entered into between a User and an Expert unless expressly stated otherwise.

The Platform may include:

The Vilij may modify, enhance, remove, replace or introduce features, services, functionality, content or membership offerings from time to time.

Content available through the Platform is intended to provide information, support, community insight and access to professional expertise. Where you are making important legal, financial, medical, educational or other significant decisions, you should consider obtaining advice tailored to your individual circumstances.

However, information made available through the Platform may not take account of your specific circumstances, needs or objectives. You should carefully consider whether any information, recommendation or guidance is appropriate for your particular situation and, where necessary, seek advice tailored to your individual circumstances.

Many Users and Experts may share personal experiences, opinions and insights. Such content reflects the views of the individual contributor and does not necessarily reflect the views of The Vilij. The Platform is provided for information, education, support and community purposes only.

The Vilij does not provide:

The Vilij does not warrant or guarantee the accuracy, completeness, suitability or applicability of any Content made available through the Platform.

Nothing on the Platform constitutes, or is intended to constitute, legal advice, financial advice, medical advice, therapeutic advice or any other form of regulated professional advice.

The Platform may allow you to view information about, communicate with or engage independent Experts and individuals who share lived experience relevant to the Platform community.

Experts are independent providers and are not employees, agents or representatives of The Vilij unless expressly stated otherwise.

Any services provided by an Expert are provided directly by that Expert and not by The Vilij.

Any contract for services is between you and the relevant Expert.

The Vilij may require Experts to satisfy certain onboarding, verification, safeguarding, insurance, qualification or professional requirements before participating in the Platform.

The Vilij does not supervise, direct or control the professional services provided by Experts and is not responsible for the content of any advice, recommendations or services provided by an Expert.

The Vilij does not guarantee:

Any onboarding, verification or safeguarding checks undertaken by The Vilij are carried out solely for our own operational, safeguarding and community purposes and should not be relied upon as a substitute for your own assessment of an Expert.

You are responsible for determining whether an Expert and any services offered by that Expert are appropriate for your needs and circumstances.

The Vilij may suspend, restrict or terminate your account where it reasonably believes that:

The Platform is intended to be a respectful, supportive and inclusive community.

You must engage with other Users and Experts in a respectful, responsible and constructive manner.

You should take care when sharing information relating to yourself, your family or any child and should not post personal information about another individual unless you have the lawful authority to do so.

The Vilij may remove content, restrict access, suspend accounts or take any other action it reasonably considers necessary to protect Users, Experts, the Platform or the wider community.

The wellbeing and safety of members of the community is a priority for The Vilij.

If you become aware of any concern relating to the safety, welfare or wellbeing of a User, child, vulnerable individual or other member of the community, you should report it as soon as reasonably practicable by sending an email to safeguarding@thevilij.co.uk within 24 hours of becoming aware of any such concern in accordance with the safeguarding reporting procedure published on the Platform from time to time by The Vilij.

The Vilij may investigate any safeguarding concern and may request information from Users, Experts or other relevant persons in connection with such investigation.

Where The Vilij reasonably considers it necessary to protect the safety, welfare or wellbeing of any individual, it may:

Any action taken by The Vilij under this clause may be taken on a precautionary basis and The Vilij shall not be required to conclude that a breach of these Terms has occurred before exercising its rights under this clause.

The Vilij may disclose information relating to a safeguarding concern where it reasonably considers such disclosure necessary to protect an individual, prevent harm or comply with applicable laws.

You retain ownership of any content, information, materials, photographs, comments, posts or other content that you submit, upload or make available through the Platform (“User Content”).

By posting User Content, you grant The Vilij a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, reproduce, display, publish, distribute, moderate, edit, adapt and otherwise use the User Content for the purposes of:

You acknowledge that User Content may be viewed by other Users, Experts and authorised representatives of The Vilij in accordance with the functionality of the Platform.

The Vilij may remove, edit, restrict access to or disable User Content at any time where it reasonably considers such action necessary for operational, legal, regulatory, safeguarding, reputational or community management purposes.

The Vilij is not responsible for User Content posted by Users and does not endorse any views, opinions or statements expressed through User Content.

Access to some areas, content, services or functionality of the Platform may be available free of charge, whilst other areas, content, services or functionality may require payment of subscription fees.

Details of applicable subscription fees, billing arrangements, renewal terms and payment methods will be provided to you before you purchase a subscription.

Unless otherwise stated at the time of purchase, subscriptions will renew automatically for successive subscription periods unless cancelled before the applicable renewal date.

You authorise The Vilij and its payment service providers to collect all fees due in connection with your subscription using your nominated payment method.

The Vilij may change subscription fees, introduce new subscription plans or amend subscription features on reasonable notice. Any such changes will not affect the current subscription period for which you have already paid unless otherwise agreed with you.

If payment cannot be successfully collected, The Vilij may suspend or restrict access to subscription-only areas of the Platform until payment is received.

Additional terms may apply to paid subscriptions, events, resources, products or services made available through the Platform.

Fees payable to Experts for services are separate from any subscription fees payable to The Vilij and are governed by the arrangements agreed between you and the relevant Expert.

Nothing in this clause affects any rights you may have under applicable consumer protection legislation.

Where you purchase a subscription as a consumer, you may have statutory rights to cancel your purchase under applicable consumer protection legislation. Details of any applicable cancellation rights will be provided to you before you complete your purchase.

Unless otherwise stated at the time of purchase, cancellation of a subscription will prevent future renewal charges but will not entitle you to a refund for the remainder of the current subscription period.

Refunds will be provided only where required by applicable law or where The Vilij expressly agrees otherwise.

All Intellectual Property Rights in and relating to the Platform, including its content, design, branding, logos, software, functionality, databases and underlying materials (excluding User Content and content owned by Experts), belong to The Vilij or its licensors.

Subject to your compliance with these Terms, The Vilij grants you a limited, non-exclusive, non-transferable and revocable right to access and use the Platform for your personal, non-commercial use.

Except as permitted by law or with the prior written consent of The Vilij, you must not:

Nothing in these Terms transfers any Intellectual Property Rights to you.

The Vilij processes Personal Data in accordance with its Privacy Policy, which forms an important part of your use of the Platform.

By using the Platform, you acknowledge that certain information and content shared by you may be visible to other Users and Experts in accordance with the functionality of the Platform and your chosen privacy settings.

Where you engage directly with an Expert, that Expert may collect, use and process your Personal Data independently of The Vilij and in accordance with that Expert’s own privacy practices and legal obligations.

The Vilij is not responsible for the privacy practices, policies or data processing activities of any Expert.

The Vilij may disclose Personal Data and other information where reasonably necessary to:

You should exercise caution when sharing Personal Data or information relating to yourself, your family or any child through the Platform.

Complaints and safeguarding concerns may be reported in accordance with the Complaints and Reporting Procedure published on the Platform from time to time.

The Vilij may investigate any complaint, safeguarding concern or alleged breach of these Terms.

In connection with any investigation, The Vilij may:

The Vilij is not obliged to resolve disputes arising directly between Users and Experts but may take action where it considers this necessary to protect Users, Experts, the Platform or the wider community.

The Platform and all Content are provided on an “as is” and “as available” basis.

The Vilij does not guarantee that the Platform, or any part of it, will be available, uninterrupted, secure, error-free or free from delays at all times.

The Vilij may modify, suspend, withdraw, discontinue or restrict access to any feature, functionality, content or area of the Platform at any time.

The Vilij may carry out maintenance, updates, upgrades or other work which may temporarily affect the availability or functionality of the Platform.

The Vilij shall not be liable for any unavailability, interruption or loss of access arising from maintenance, technical issues, third-party service failures or circumstances beyond its reasonable control.

Nothing in these Terms excludes or limits liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

To the fullest extent permitted by law, The Vilij shall not be liable for:

The Vilij may suspend, restrict or terminate your access to all or any part of the Platform where it reasonably considers that:

You may stop using the Platform at any time and may cancel any subscription in accordance with the applicable subscription terms.

The Vilij may amend these Terms from time to time by providing notice through the Platform.

Continued use of the Platform following the effective date of an amendment constitutes acceptance of the updated Terms.

If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between you and The Vilij relating to your use of the Platform.

A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms.

The Vilij may assign, transfer or otherwise deal with its rights and obligations under these Terms.

These Terms are governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction.
